Came the following jury to wit. William McFarland, James Campbell, George Graham, William Kimbrough, Andrew Henderson, Thomas Rankin, Nicholas Davis, Samuel Gass, Baldwin Harle, George Rogers, John Edmund (?), and Samuel Gilbreath, who being elected tried and sworn will and truly to try the issues in this case, upon the oaths do say that the defendant is not as well known by the name of Abraham as that of Ebenezer. It is therefore considered by the court that the defendant be discharged and that the indictment as to the said Abraham Leeth be quashed.
